1.Competitions

All draws conducted by the Promoter on its Website, offering chances to win Prizes, are collectively referred to as the “Competition” or “Competitions” in these Terms and Conditions. This includes one-time Prize Competitions and additional instant win prizes (“Instant Win Prize”) within those Competitions.

The Promoter may operate multiple Competitions simultaneously, each with a specific Prize and the potential for Instant Win Prizes, as outlined in Clause 6 below.

The availability and pricing of Competitions are determined by the Promoter and will be specified on the Website. Each Competition provides both a free entry option and a paid entry option. The availability of a free entry route for each Competition ensures that the Competition does not qualify as a lottery under the Gambling Act 2005 and can be legally operated in Great Britain without requiring a license.

Each Competition will run for the specified period. Please refer to the Website’s promotion for each Competition to find details regarding start and end times and dates (“Promotion Period(s)”).

Each Competition will run for a predetermined duration specified at the creation of the Competition. Competitions will conclude when the timer expires. However, the Promoter reserves the right to end Competitions earlier at their discretion.

2.Eligibility and Compliance

Competitions are open to all individuals aged 18. or over, except for employees of the Promoter or any individuals connected to the Promoter (e.g., through family, professional, or commercial association) who are prohibited from participating in Competitions.

By entering a Competition, the entrant (“Entrant,” “you,” “your(s),” or “Customer”) will be deemed to:

  • Have the legal capacity to participate.
  • Have read, understood, and accepted these Terms and Conditions.
  • Be bound by these Terms and Conditions and any other requirements stated in the Promoter’s related promotional material on the Website.

By participating in a Competition, either through online entry on the Website or by postal entry, you confirm that you are not violating any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held accountable for any Entrant unlawfully participating in our Competitions. If you have any doubts, you should immediately exit the Website and consult the relevant authorities in your country.

The Promoter reserves the right to refuse entry to a Customer at their discretion.

All Competitions are governed by English law, and any matters or disputes related to the Competition will be handled and resolved according to English law. The exclusive jurisdiction for such matters or disputes shall lie with the Courts of England.

 

3.How to Participate

3.1 In order to participate in any Competition, you must initially create an account on our Website. To register online, you will be required to provide an email address or log in using a social media account, such as Facebook, Twitter, or Gmail. Once registered, you must either (i) complete the provided online entry form on the Website or (ii) send a postal entry to the Promoter. In both cases, the entries must be received by the end of the specified Promotion Period for the Competition, as indicated on the Website. During the registration process, all participants must acknowledge that they have read and accepted the Terms and Conditions.

3.2 All participants must furnish their contact details, including:

  • Full name
  • Date of birth
  • Email address
  • Postal address
  • Contact telephone number (referred to as ‘Contact Details’)

The Contact Details will be used for verifying entries, notifying winners about their Prize, publishing the winner’s name and location on the Website (unless an Entrant requests otherwise in accordance with clause 8.2), and any other purposes outlined in our Privacy Policy available on the Website.

 

3.3 – Online Entries: To participate in an online competition through the website, you must follow the instructions on the screen. This involves selecting the competition you want to enter and providing your contact and payment details when you are ready to purchase your tickets. This process is known as online entry. It is important to review your details carefully, acknowledge the declaration stating that you have read and understood the competition terms and conditions. Once you have completed the ticket purchase, registered for the relevant competition, chosen your number, and your payment has been cleared, we will send you a confirmation email to verify your entry into the competition.

3.4 – Postal Entries: When entering a competition through postal mail, there is no cost associated. All participants must indicate the competition they wish to enter and provide their contact details by sending a letter to the following address: 2Easy Competitions Ltd, 2 Easy Competitions PO Box 234 Sheerness ME12 9BZ. Each entry sent by mail is referred to as a postal entry. The postage for each entry should be paid either as first-class or second-class mail. Multiple entries within the same envelope will not be accepted. Postal entries should not be submitted directly through the letterbox but sent to our PO Box. Each registered account is allowed multiple entries per competition. Participants are not limited to one entry per person per competition. Every postal entry has an equal chance of winning a prize or an instant win prize as an online entry.

3.5 – Deadline for Entries: Online entries, must be received by the end of the promotion period specified for a particular competition (free postal entry must be received within 48 hours of the closure date, see clause 3.13 below). For all competitions, the promoter will assign random numbers to each entry. Once the numbers have been allocated, postal entries will be treated in the same manner as paid online entries. If a competition has reached its capacity by any means by either free postal or paid, no further entries will be accepted, and this information will be stated on the website.

3.6 – Confirmation of Entry: Please note that regardless of whether you submit an online entry or a postal entry, your participation in the competition will not be considered valid until we confirm your entry. This confirmation can be viewed in your account when you log in, or we may send you an email to confirm your entry. Both online and postal entries are referred to as “entry” or “entries” in this context.

3.7 – Refusal or Disqualification of Entries: The promoter reserves the right to refuse or disqualify any incomplete entry if there are reasonable grounds to believe that an entrant has violated any of the terms and conditions stated.

3.8 – Disqualification for Contrary Conduct: The promoter reserves the right to disqualify an entry if there are reasonable grounds to believe that the entrant’s conduct goes against the spirit or purpose of the competition. This includes conduct that may be abusive, racist, or involves posting defamatory comments on the website or on social media platforms.

3.9 – Ownership of Entries: All entries are considered final, and no refunds will be issued except as specified in Clause 4.8. To the extent permitted by applicable law, all entries become the property of the promoter and will not be returned.

3.10 – Processing of Postal Entries: Postal entries will be processed on a daily basis. If a competition has reached its capacity by any means by either free postal or paid entry, the website will indicate that the competition is at capacity, and no further entries will be accepted. Allowing for equal opportunities for all entry routes.

3.11 – Multiple Entries and Instant Win Prizes: An entrant can participate in each competition up to the maximum number of times specified on the competition’s page on the website. You may make multiple free entries for any competition, up to any limit placed on the competition entries allowed for both routes (paid or free entry). Each free entry must be submitted and posted to the promoter, using the PO Box address separately, bulk entries will not be accepted as multiple entries and need to be sent individually, using a 1st or 2nd Class stamp.  Each participant in a competition will automatically be eligible for any instant win prizes associated with that competition.

3.12 – Entry Limits and Closure: Each competition will have a minimum of 1 entry and a maximum of 999,999 entries. A competition will close either when the last number is taken or when the competition timer expires, and no further entries will be accepted after that point.

3.13 – All free postal entries need to be received within 48 hour of the closure date.

3.14 – Instant Win Add-On Prizes: Once an entry is confirmed, and the letter and number combination for that entry is finalized, whether randomly allocated or chosen by the entrant, the entry will be submitted into the competition database. It will be eligible for any instant win prizes if the entrant has the winning number/letter combination. Each postal entry has an equal chance of winning an instant win prize as a paid online entry.

  1. Choosing a Winner

4.1 2Easy Competitions Ltd ensure that the winner of each Prize (referred to as ‘Prize Winner(s)’) is determined by a random number generator. The number of participants in a Competition determines the number of entrants into the random generator software. Each Competition will have a minimum of 1 entries and a maximum of 999,999 entries. The result will be live-streamed on YouTube, Facebook, Instagram and/or another designated live streaming platform chosen by the Promoter. In certain situations, at the discretion of the Promoter, an alternative method may be used to select a winning number, ensuring verifiable randomness.

4.2 Only one main Prize Winner will be chosen for each Competition, unless stated otherwise by the Promoter on the website. Additionally, there may be Instant Win Prize Winners (see 4.3 below). The Promoter’s decision is final in all matters related to the Competition.

4.3 For all Instant Win Prizes in a Competition, the winning numbers will be randomly selected shortly before the start of the Competition and cannot be altered. These numbers will be encrypted in the database and kept hidden from all Promoter staff.

4.4 The Promoter will make every effort to contact Competition and Instant Win Prize Winners using the provided Contact Details at the time of entry (or any subsequent updates), securely stored in their database. Entrants must ensure that their Contact Details are accurately recorded. It is the responsibility of the Entrant to maintain accurate, up-to-date, and complete Contact Details. The Promoter will not be held accountable for any consequences arising from incorrectly recorded, inputted, or submitted Contact Details.

4.5 If the Promoter is unable to contact a Prize Winner within five (5) working days (which may be extended at the Promoter’s discretion) after the end of a Competition, or if the Prize Winner fails to confirm acceptance of the Prize for any reason, or is disqualified due to non-compliance with these Terms and Conditions, the Prize Winner agrees to automatically forfeit the Prize. The Prize will remain in the possession and ownership of the Promoter.

4.6 Entrants who give specific consent to receive marketing communications will be added to the Promoter’s database. This is done for the purpose of providing updates on Competition status, as well as information about future promotions or Competitions offered by the Promoter.

4.7 The Promoter will draw a Prize Winner for each Competition at the end of the stated Promotion Period on the Website. The Promotion Period will not be extended, and all prizes will be awarded regardless of the number of entries received. The draw date may be brought forward if the maximum number of entries has been reached. If the Promoter closes a Competition early, the Prize Winner will be selected from all valid and eligible entries received prior to the closure date.

4.8 The Promoter will draw an Instant Win Prize winner for each Competition that includes Instant Win Prizes during the stated Promotion Period on the Website. No Instant Win Prizes will be available after the Promotion Period. All Instant Win Prizes will be awarded regardless of the number of entries received.

4.9 The Promoter reserves the right to cancel any Competition at any time, even after entries have been sold. In the event of a cancellation, the Promoter will notify each Entrant via the provided email address and refund any payment made by the Entrant using the same method of payment. Alternatively, the Promoter may offer a game credit for the Entrant to use in a subsequent Competition. Once a payment has been refunded, the Promoter will have no further liability towards the Entrant or any other person.

 

  1. Winner’s Details

5.1 Each Prize Winner must provide documentary proof of their age (18+) and identification before receiving the Prize. Failure to meet this requirement may result in disqualification, and the Promoter may reallocate the Prize.

5.2 The Promoter will seek consent from each Prize Winner to use their photographs and/or request them to pose for photographs and videos. The Prize Winner’s personal details, including details of any Prize won, may be included in marketing materials. If a Prize Winner consents, these photographs, videos, and marketing materials may be used by the Promoter in future marketing and public relations activities related to the Competition, identifying them as a Prize Winner.

5.3 After receiving and verifying the requested details, provided that the Prize Winner has met all the Terms and Conditions, they will be contacted to arrange delivery of the Prize.

 

  1. Competition Prizes:

6.1 The Prizes will be chosen by the directors of the Promoter and may either be owned or purchased by the Promoter. The details of each Prize can be found on the Competitions pages of the Website. Once the Prize Winner receives the Prize, the Promoter takes no responsibility for any issues or damages that may occur. Insurance for the Prizes is not included.

6.2 Delivery of the Prize to the winner’s home address in Great Britain is free of charge. If the Prize needs to be delivered to an address outside Great Britain, the Promoter may charge delivery fees. Regardless of location, all Prize Winners have the option to receive a cash alternative instead of the Prize.

6.3 The Prize Winner is responsible for any expenses incurred to collect the Prize. Additionally, the Prize Winner is responsible for any taxes, duties, or charges related to receiving the Prize.

6.4 The Prize Winner acknowledges that the Prizes are subject to the terms and conditions of the Promoter, Prize provider, manufacturer, supplier, or any other party involved in providing or delivering the Prize. These terms and conditions will be communicated to the Prize Winner before receiving the Prize.

6.5 Each Prize must be accepted as awarded and cannot be transferred, converted to other substitutes, or combined with any other vouchers, offers, or discounts, including those provided by the Promoter or other Prize suppliers.

6.6 If offered by the Promoter, Prize Winners have the option to choose between receiving the full Prize or a cash alternative. Acceptance of the cash alternative is not mandatory, and the full Prize described in the Competition’s details will be awarded unless the cash alternative is chosen.

6.7 If the prize is a vehicle, no insurance is included with the prize and it is the prize winners own responsibility to insure the vehicle. As the promoter, we will ensure the vehicle comes with a valid MOT unless otherwise stated (if required). No vehicle comes with road Tax included. 

  1. Storage:

The Promoter can store the chosen Prize free of charge for up to 21 days after notifying the Prize Winner. If storage by the Promoter exceeds 21 days, the Prize Winner will be responsible for covering the cost, which must be paid before receiving the Prize.

  1. Winners’ Personal Data:

8.1 With the Winner’s consent, the Promoter may request to take photos and videos of the Winner for promotional purposes, such as Public Relations and Marketing.

8.2 When entering a Competition, Entrants may be asked to consent to the use of their name, address, photograph, likeness, and participation in publicity events without additional compensation, except for pre-approved reasonable travel expenses. Entrants have the right to withhold consent for these uses of their Contact Details.

  1. Limits of Liability:

9.1 The Promoter does not provide any representations, warranties, or assurances regarding the quality, suitability, or fitness for any specific purpose of the goods or services offered as Prizes. Except for liability in cases of death, personal injury caused by negligence, fraudulent misrepresentations, or circumstances where limitations are prohibited by law, the Promoter is not liable for any loss or damage sustained by the Prize Winner or anyone accompanying them in connection with the supply of goods or the Competitions promoted by the Promoter.

9.2 The Promoter’s maximum liability to each Prize Winner is limited to the total value of the won Prize.

9.3 If you are an Entrant who is not a Prize Winner, the Promoter’s maximum liability to you is limited to the amount you paid to enter Competitions within the first 12 months of playing.

9.4 These terms and conditions do not restrict your statutory rights.

 

  1. Electronic Communications:

The Promoter is not responsible for failed, partial, or garbled computer transmissions, hardware or software malfunctions, internet connectivity issues, or unauthorized acts that may affect the Competitions. If a Prize is incorrectly awarded due to technical or human errors, the Promoter reserves the right to reclaim the Prize and award it to the correct Entrant without liability. The Promoter strives to ensure the correct functioning of its software and website across various browsers, but it is not liable for any malfunctioning software or events leading to Competition Entries.

 

  1. Data Protection Notice:

Personal data provided by Entrants or obtained from third parties (e.g., credit card companies) will be processed by the Promoter to administer the Competition and fulfill Prizes, as outlined in the Privacy Policy on the Website. The Promoter may disclose personal data to credit card companies, individuals involved in transferring rights/responsibilities, potential buyers of the Promoter’s business, and to comply with legal requirements or prevent fraud. Transfer of personal data outside the United Kingdom will be handled responsibly by the Promoter to ensure adequate protection.

 

  1. Validation: The Promoter reserves the right to withhold the delivery of a Prize to a Prize Winner until certain conditions are met: (i) the Prize Winner has a validly registered Website account and is not in breach of the terms and conditions, (ii) any outstanding amounts owed to the Promoter have been fully paid, and (iii) the age, identity, and entitlement of the Prize Winner have been satisfactorily verified by the Promoter. The Promoter may request documentary proof of age and identity before giving or awarding a Prize. Additionally, the Promoter reserves the right to refuse the awarding of a Prize or retrieve a Prize or its value if fraud in relation to a Competition is reasonably suspected. The Promoter may, at its absolute discretion, award a Prize to a person who is the duly authorized representative of the Prize Winner, acting under a lawfully executed power of attorney or equivalent authorization.

 

  1. Account Security: You are responsible for maintaining the security and confidentiality of your account password at all times. To ensure account security, you must: memorize your password and never disclose it to anyone, avoid writing it down or recording it in a way understandable by others, delete any password-related communications from the Promoter after reading them, use a password that is not easily guessed, prevent others from using your account while you are logged onto the Website, log off or exit your account when not in use, and keep your password or access information confidential. Your password and log-in details should not be shared or used to provide shared access over a network. You should use a unique password for your account and maintain good internet security practices. If you suspect unauthorized use or disclosure of your account or password, or if someone else knows your password, you must notify the Promoter immediately. In case you forget your password, you can reset it using the instructions on the Website, provided you can provide the necessary security information requested by the Promoter. The Promoter shall not be held responsible or liable for any breaches of these account security rules or for any actions or consequences resulting from the use of the Website.

 

  1. Changes: The Promoter may update and revise its terms and conditions periodically, and the most current version will be posted on the Website as soon as possible. It is recommended to periodically check the page to stay informed about the applicable terms and conditions. By continuing to access and use the Website after the revised terms and conditions take effect, you agree to be bound by them. The Promoter may also make updates and changes to the Website and Competitions to reflect changes in offerings, IT systems, user needs, and feedback, among other things.

 

  1. Unauthorized Debit Card Use and Card Expiry: If you report unauthorized use of your debit card related to a Competition and your bank or building society requests the Promoter to return the corresponding amount to your account, the Promoter may suspend your account and require you to contact them. The Promoter accepts no responsibility and will not be liable for any chargebacks. In the event that your debit card is due to expire, the Promoter will make reasonable efforts to return the funds in your account to your debit card before midnight on the expiry date. If this is not possible, the Promoter will attempt to notify you, and you should contact them to arrange an alternative method for fund return.

 

  1. Cancellation of Payments and Bank Reversals

If you wish to dispute any payment made to us, please contact us immediately to discuss reimbursement.

In the event that you initiate an unwarranted chargeback (such as a credit card or debit card chargeback, cancellation of a check, or submission of a returned check), you will be responsible for the following within 7 days for each chargeback:

  • Payment for any Competitions you participated in during the period covered by the chargeback.
  • Any fees and charges incurred by us in recovering the aforementioned fees, including debt recovery costs, legal fees, and debt collection expenses, at our discretion.

If an unjustified chargeback occurs as mentioned in Clause 16 above, we reserve the right to terminate your account on our Website.

 

  1. Usage of the Website

17.1 By agreeing to these terms and conditions, you acknowledge that: (i) The Website and/or the Competitions are intended for your personal, non-commercial use. (ii) You are only permitted to use your account, access the Website, and enter Competitions as outlined in these terms and conditions.

17.2 You further agree to use your account, enter Competitions, and access and/or use the Website in a suitable and lawful manner. You will not:

  • Receive, access, or transmit any content that is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in violation of any intellectual property rights (including copyright), or otherwise objectionable and/or unlawful.
  • Knowingly and/or recklessly transmit any content (including viruses) through the Website and/or the Promoter’s software and IT systems that may cause harm or damage to the Website, the Promoter’s software and IT systems, or others’ data.
  • Engage in hacking activities, excessively burden computer systems, distribute chain letters, “junk mail,” surveys, contests, pyramid schemes, or any behavior intended to obstruct others from participating in Competitions or using the Website or any other website, or behavior that could harm the reputation or business of the Promoter or any third party.
  • Allow or authorize anyone to perform the actions described in 17.2(i)-(iii).

17.3 You hereby agree to indemnify the Promoter against any costs, losses, damages, and expenses incurred as a result of any claim, legal proceeding, or demand made by a third party due to or arising from your unlawful, wrongful, or negligent access and/or use of your account, the Website, or the Promoter’s software and/or IT systems, or any breach of these terms and conditions.

17.4 The correct display of the Website on all devices cannot be guaranteed.

17.5 The Promoter owns or holds licenses for all copyright, trademarks, and other intellectual property rights related to the Competitions, Entries, and the Website. You will not acquire any rights to any of these.

17.6 Trademarks used on the Website and/or in connection with the Competitions are either owned by the Promoter or used for identification purposes only and may belong to their respective owners. You will not acquire any rights to any of these.

17.7 You must not:

  • Copy, disclose, transmit, or otherwise make available any material from the Website.
  • Reverse engineer or decompile any software used in connection with the Website or the provision of Competitions (except as expressly permitted by applicable law).
  • Remove, obscure, or change any copyright, trademark, or other intellectual property notices in any material obtained from the Website or as a result of participating in Competitions.

17.8 You agree that participating in Competitions (as well as accessing and/or using your account) while located in any jurisdiction other than Great Britain is strictly prohibited.

 

  1. Discretion

The Promoter’s exercise of any discretion granted in these terms and conditions will be final and binding.

 

  1. General

19.1 The Promoter’s failure or delay to enforce a provision of these terms and conditions does not waive its right to do so later.

19.2 If any provision (or part of a provision) of these terms and conditions is deemed void or unenforceable by a court of competent jurisdiction, that decision will only affect the particular provision (or part of the provision) and will not render the other provisions void or unenforceable.

19.3 You are not permitted to assign or transfer your rights and/or obligations under these terms and conditions. Any breach of this rule may result in the immediate suspension or termination of your account, the provision of the Competition, or access to the Website by the Promoter. The Promoter may assign or transfer its rights and/or obligations under these terms and conditions to any third party at its sole discretion and without your consent. The Promoter may also assign these terms and conditions in their entirety, without your consent, to its successor in interest in connection with a merger, reorganization, or sale of all or substantially all of its assets or equity. These terms and conditions shall bind and benefit the Promoter, its successors, and permitted assigns.

19.4 These terms and conditions constitute the entire agreement between you and the Promoter regarding the subject matter herein and supersede any prior agreements, terms, and conditions applicable to the subject matter.

19.5 A person who is not a party to these terms and conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any provision of these terms and conditions.

19.6 The Promoter will not be held liable for any delay or failure to perform any obligation under these terms and conditions resulting from causes beyond its reasonable control.
